The suspects in the Duran Central Pharmacy shooting each make a deal

ALBUQUERQUE, N.M. – Two suspects in an accidental shooting that injured a man at Duran’s Central Pharmacy in January have each taken a plea deal to do so.

Court documents show Amanda Sheppard pleaded no contest to tampering with evidence on Thursday, while Jonathan Olivas pleaded guilty to a charge of tampering with evidence in September.

Sheppard was charged with unlawful carrying of a firearm in a licensed liquor establishment, negligent use of a firearm and unlawful carrying of a deadly weapon – but those were dropped with the plea deal. Olivas was only charged with tampering with evidence.

According to police, Sheppard and Olivas turned themselves in a few days after the shooting, which sent a man to the hospital with a gunshot wound to the back of the head.

According to APD, Olivas told investigators that Sheppard had a .22 caliber revolver in her purse. Then, as the purse fell to the floor, he heard a “crack.” Looking down, he saw the gun, picked it up and put it in his pocket before leaving the restaurant.

Surveillance video showed him and Sheppard getting up from the counter at Duran’s and leaving after the gun was fired.

Sheppard told investigators she didn’t know the gun was in her purse because she doesn’t normally carry it with her. She said she didn’t have a concealed carry permit. She also believed the “bang” was a high chair falling to the floor.

Olivas will serve 18 months of supervised probation as part of a conditional discharge. This means he must stay out of trouble and adhere to certain conditions.

According to the Bernalillo County District Attorney’s Office, a judge also granted Sheppard a conditional discharge.
