Parents hire an illegal complaint after a fatal Osage Beach plane crash

The parents of a teenager, who was killed near Osage Beach in 2023, submitted illegal deaths in which he claimed Pilots' negligence.

Gary and Penny Vandiver filed the lawsuit in Camden County on Monday and searched for more than $ 25,000 in damages at the Pilot Hayden Ritchhart estate because of the death of her 19-year-old son Evan Vandiver.

The plane crash occurred on July 13, 2023 near Grand Glaize-Asage Beach in Camden County.

Evan Vandiver was killed in the crash and the 54 -year -old Gary Vandiver was seriously injured.

The 22 -year -old pilot Hayden Ritchhart was also killed in the crash, and his estate was called the complaint in the lawsuit.

Lawyer Timothy McDuffey was appointed the accused ad litem.

The lawsuit comprises three counts: one for the illegal death of Evan Vandiver, another for the person injuries that Gary Vandiver had suffered in the crash, and a third for the loss of Consortium Penny Vandiver due to the death of her son and the injuries of her husband.

In the lawsuit it is claimed that Ritchhart's actions as a pilot were negligent and careless and that he did not have ordinary care when operating the aircraft.

The submission of the court claims several missteps, including the failure of a proper execution of a proper template, the non-setting of the proper settings for the trim tab before starting or correction of the flight, the non-recognition of the nose height of the aircraft and the towing ascent and the aircraft that is exceeded, which is in the stable and crash results.

The lawsuit claims that these actions of Ritchhart had led directly to Evan's death and Gary's serious injuries.

In an NTSB report of the aviation examination published on November 21, 2024, it was found that the likely cause of the crash was that Ritchhart did not properly determine the stability representative of the aircraft before the start, which led to an exceeding of the critical hint of the aircraft and an aerodynamic stable during the network.
