The defense attorney points to a possible re-sentencing of the Menendez brothers

SAN DIEGO (KGTV) – Criminal defense attorney David Shapiro was on set with ABC 10News to discuss the impact of Los Angeles District Attorney George Gascón’s resentencing recommendation in the Menendez brothers’ case.

ABC 10News anchor Kimberly Hunt asked Shapiro the following questions:

• The next step in this process is how the judge handles the recommendation. Can you explain this process and give us an estimate of how long it might take?
• What exactly does the judge have to decide or take into account? Whether the abuse took place, whether they pose a danger to society or whether they compare it with other cases? What boxes do they need to check?
• Although it was a good day for the defense, they are calling for the 1996 verdict to be overturned because sexual assault testimony was wrongly withheld from the jury. Is that a bridge too far?
