A judge has declined to reconsider criminal charges against Alec Baldwin over the death of Halyna Hutchins.
The cameraman was accidentally shot on the set of “Rust” in 2021, but Judge Mary Marlowe Sommer now insists that involuntary manslaughter charges dismissed in July will not be reconsidered.
She wrote: “The State presents no factual or legal arguments that would justify accepting a motion for reconsideration.”
The charges were dismissed earlier this year after it emerged during the trial that prosecutors had withheld evidence from the defense.
At the time, the actor’s lawyers claimed that live ammunition had been “hidden” from them in connection with the investigation.
In response to the latest request, the judge stated: “Because the State’s amended motion raises arguments previously made and arguments not previously made by the State, the court finds the amended motion not well considered.”
Baldwin, 66, was indicted by a New Mexico grand jury in January after the gun he was holding during a rehearsal on the set of “Rust” fired, killing Hutchins and injuring the film’s director, Joel Souza. injured.
Baldwin later claimed that he did not pull the trigger on the gun or know why it contained live ammunition.
Hannah Gutierrez-Reed, the film’s gunsmith, was jailed for 18 months in April after being found guilty in connection with the incident.
“Rust” resumed filming and finished filming in May 2023. In an Instagram post marking the completion, he said: “It’s been a long and difficult road. But today we reach the end of the road.”
