Mangione lawyers claim to violate Hipaa violation of the murder case of the Unitedhealthcare CEO

Luigi Mangione's lawyers claim that Manhattan's public prosecutor's office broke the law by secretly gaining access to his private health records.

In a new court registration, the defense accused the defense of violating Hipaa, the federal law that protects medical privacy. They say that the office of the DA has put pressure on Mangione's health insurers Aetna to hand over documents without judicial order or approval of a party involved.

After registering, the prosecutors lacked a court appointment and used a “false and fraudulent” summons that warns Aetna who despises it in court if it is not complied with.

The lawyers of Mangione are now asking the judge to sanction the office of there, including the possibility of fully throwing the indictment. They request a formal hearing in this matter.

Manhattan's public prosecutor told Fox News that there would be responding in court files. It is said that very limited information was requested by Aetna and Aetna sent additional materials.

“We deleted the materials as soon as we became aware of them and brought them to defend and the court's attention,” said the office.

Mangione is accused of murdering the CEO of Unitedhealthcare, Brian Thompson in front of the Hilton Hotel in Midtown Manhattan, on December 4, 2024, shortly before the company's annual investor conference.

According to the prosecutor, Mangione used a homemade ghost gun, which was equipped with a silencer, and Thompson shot twice up close to the scene.

The office that argues that the killing is ideologically motivated and called an action that “violently sends a social and political message to the public in public”. According to court files, Mangione allegedly marked ammunition with the words “deny”, “delay” and “discontinued” and described himself as a “revolutionary anarchist”.

The public prosecutor also quote journal entries and a note to the FBI, in which mangion supposedly expressed symptoms against the US health system and wrote that “these parasites simply let it come”.

Mangione has not guilty.

Defenders are published separately for the suppression of mangion's statements in law enforcement authorities and evidence of his backpack. They argue that both have been preserved illegally. They also asked the court to reject charges in connection with terrorism, and refer to constitutional concerns regarding the double danger and the simultaneous public prosecutor.

The office of the DA calls it “an open and closed case” and argues that the evidence is “overwhelming”.

A judge now decides whether he should give the defense's request to hear a hearing to the alleged hipaa violation. The broader application for dismissal and oppression is still pending.

The state case drives in front of a separate public prosecutor in which the government is aiming for the death penalty.
